  • Representing various international franchise hotel chains in various CIETAC arbitrations involving terminations of hotel management agreements and technical services agreements.
  • Acting for various major hotel groups in personal injury matters happening in their respective hotels, representing clients in domestic Chinese Courts to settle the disputes.
  • Representing hotel groups and their insurers in disputes arising from property damages in front of domestic Chinese courts.
  • Advising the main contractor in CIETAC arbitration proceedings against its sub-contractor regarding a hotel development in Beijing, China.
  • Advising an international hotel group in relation to payment issues against local developer in China.

Insurance and reinsurance

  • Representing one of the largest foreign-owned insurance companies in mainland China in an arbitration proceeding against the logistics service provider and obtaining a very favourable multi-million RMB arbitration award. The dispute arose from the high profile Tianjin port explosion in 2015 (one of the largest made catastrophes in global insurance history), in relation to damage to thousands of automobiles stored at the logistics service provider’s premises.
  • Successfully defending a international insurer in a substantial CIETAC arbitration in relation to two reinsurance agreements against a domestic Chinese insurer, with significant counter-claims involved. This case involves novel legal issues and is important to the client’s localisation strategy in China.
  • Assisting an international insurer in pursuing subrogation recovery arising from a catastrophic fire incident by means of legal proceedings in China. Substantial claim amount and the case involves complicated negotiations with local government departments.
  • Representing a major Chinese insurer in a high profile D&O matter regarding claims against a US listed company and its directors and officers.
  • Advising various leading insurers on product liability issues against local Chinese manufacturers.
  • Advising a leading reinsurer in the UK to advise on policy coverage issues and rights and obligations under the reinsurance contract (in particular, the claim cooperation clause, “follow the fortunes” clause) arising from the reinsurance contract with a Chinese insurer.

  • Advising an international reinsurer in the US to advice on policy coverage issues and reinsurance issues under the reinsurance contract; the original policy is for export credit insurance and the claim involves the civil war in Libya with the claim amount of over EUR 10 million.

  • Representing and advising various interests (including reinsurers) arising from the most high-profile and serious maritime oil pollution incident in China’s maritime industry at the Penglai 19-3 oil field resulting in the establishment of compensation funds worth USD 480 million.

  • Assisting a leading reinsurer in Chinse court proceedings in relation to a large gas explosion accident in Hainan.
  • Acting for shipowners in relation to a possible default under a ship sale. Vessel was subsequently arrested by the adverse party in China and various negotiations/discussions were convened with the local Chinese.
  • Advising and acting for clients on claims by shipowners arising out of alleged breaches of Contracts of Affreighment, including defending clients in arrest applications taken out by shipowners for the arrest of bunkers in mainland China to obtain security for their claim.
  • Advising and assisting clients on negotiating and obtaining salvage security from Chinese cargo interests; cargo discharge operations and storage options in mainland China while cargo was under salvors’ lien.
  • Assisting a leading global resources company to arrest a vessel in Ningbo where guarantees were set for a debt arising out of the performance of a series of freight forwarding agreements.

  • Advising a state-owned oil company on disputes arising from a collision between a tanker and a terminal’s berth, which includes the charterer’s fulfilment of nomination of safe port, demurrage claims and late delivery of cargo claims.

  • Assisting several Chinese shipyards in relation to disputes over quality of the vessels and payment obligations etc.

  • Acting for a Chinese lender syndicate on financing of the construction and delivery of three Arc 7 LNG ships (also known as ‘ice breaker’, a new type of LNG ship which can transport LNG under extreme cold weather condition)

Applying for the recognition and enforcement of a salvage arbitration award issued by the arbitrator appointed by the Council of Lloyd’s to hear the dispute arising out of the apportionment of salvage remuneration.
